PRIVACY AND DATA PROTECTION POLICY

ULTIMATEMOD – CONSTRUÇÃO MODULAR, S.A. (commercially known as KREAR), values and respects the privacy of its Customers, potential Customers and third parties who interact with it, and has established the present Privacy and Data Protection Policy, with a commitment to the highest standards of security and privacy.

Personal data is processed in accordance with its purposes and the rights enshrined in legislation, in a lawful, fair and transparent manner and limited to the authorised purposes, ensuring respect for the legal principles in force for the area of privacy and protection of personal data, namely the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council – General Data Protection Regulation (GDPR) – and other applicable legislation on privacy and data protection, including national legislation that complements the GDPR.

The regulations set out in this Privacy Policy complement the provisions on personal data set out in the contracts entered into with KREAR.

Providing your personal data implies knowledge and acceptance of the terms and conditions contained herein. Therefore, by providing your personal data, you are authorising the collection, use, as well as disclosure of the same among the companies that are part of KREAR, in accordance with the regulations defined herein, namely not to use information relating to users that has been provided by them without their authorisation, except for the purposes for which it is intended.

By accessing the website we consider that users are aware of the procedures contained in this privacy policy and accept them without any reservations, conditions or modifications.

KREAR is responsible for processing the personal data of its customers and/or potential customers and third parties who interact with it, insofar as it provides services and supplies goods, and decides what data is collected, how it is processed and for what purposes it is used. PERSONAL DATA

Personal data means any information, of whatever nature and regardless of its medium, relating to an identified or identifiable natural person (an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity).

PURPOSES AND LEGAL BASIS FOR PROCESSING

The purpose of processing the data collected by KREAR is to enter into contracts for the provision of goods and services, to respond to requests from customers/users and to manage the contractual relationship through the use of post, email and telephone. The data collected may also be processed for promotion or marketing purposes, namely to disseminate information, new products, commercial offers and services by e-mail, telephone or post. The processing of personal data carried out by KREAR will always be based on one or more of the legal grounds set out in the General Data Protection Regulation – 2016/679 (GDPR) and other applicable legislation on privacy and data protection, including national legislation that complements the GDPR, the legal grounds mainly used by KREAR being the following:

  • Consent of the data subject, under the terms of Article 6(1)(a) of the GDPR, whenever consent is given for the processing of personal data (such as for direct marketing purposes, among others), the processing will be carried out under the terms strictly consented to. The data subject may withdraw consent at any time, without such withdrawal affecting processing carried out while said consent was in force.
  • Execution and/or management of the contract or other pre-contractual steps, within the scope of Article 6(1)(b) GDPR, which includes, in particular, the processing of personal data for the purpose of maintaining KREAR’s contractual relationship with the Customer or potential Customer and/or data subject and to enable the provision of services, execution of contracts and processing of requests, as well as all operations necessary within the scope of the conduct and management of KREAR’s activity.

RIGHTS OF PERSONAL DATA SUBJECTS

NUnder the terms of the Personal Data Protection Act, the data subject is guaranteed the right to access, update, rectify, limit or delete their personal data at any time, as well as the right to object to the use of the data provided for marketing purposes (without jeopardising the lawfulness of the processing carried out on the basis of the consent previously given), which it can do through the contacts provided. The data subject is also guaranteed the right to lodge a complaint with the competent supervisory authority, in this case the National Data Protection Commission.

TRANSFER OF PERSONAL DATA OR USE BY THIRD PARTIES

The provision of certain services by KREAR may occasionally involve the transfer of personal data outside of Portugal, but in this case the applicable legal provisions will be duly observed, particularly with regard to determining the suitability of that country with regard to the protection of personal data and the requirements applicable to such transfers. In the course of its business, KREAR may use subcontractors to provide certain services, which may involve such entities accessing personal data entrusted to them. Whenever this happens, KREAR takes the appropriate precautions to ensure that the subcontractors with access to the data are reputable and offer all the necessary guarantees to protect the personal data of the owners of said data. KREAR may also share personal data to third parties, i.e. organisations that will use the data for their own purposes. In cases where such communication may occur, namely by legal provision, the respective data subject will be duly informed. Under legal terms, KREAR may also be obliged to provide the personal data of data subjects to Portuguese governmental or judicial authorities.

NON-PERSONALLY IDENTIFIABLE INFORMATION

KREAR also collects non-personally identifiable information to track data such as the number of visits to the website. We use this information to understand how our visitors use the website and so that we can improve the website, as well as the services we offer.

USE OF IP ADDRESSES

KREAR or third parties operating on our behalf may collect IP addresses for system administration purposes and to audit website usage. IP addresses are not linked to personally identifiable information and users remain anonymous. KREAR adopts various technical and organisational security measures in order to protect the personal data that is made available, namely against its dissemination, loss, misuse, alteration, unauthorised processing or access, as well as against any other form of illicit processing.

KREAR employees are bound by a commitment to confidentiality and absolute secrecy with regard to the data they have access to and undertake to use it for the strict purpose for which it was collected.
